These terms of service govern the use of services offered by EME Automations (hereinafter "EME", "we", or "us") through our website and associated platforms. By using our services, you agree to these terms in full.

The engagement of our services is formalized through a written agreement (commercial proposal, accepted quote, or contract). Unless otherwise stated:
Accepted payment methods will be communicated at the time of engagement and may include bank transfer, PayPal, MercadoPago, or other methods depending on the client's location.
Delivery timelines are agreed upon individually for each project and detailed in the commercial proposal. EME commits to meeting agreed timelines and will communicate any delays with reasonable notice. Delays caused by the client (missing information, pending access, scope changes) are not EME's responsibility.
If you subscribe to any of our SaaS platforms (Emalia, Centralwap, or others), the following additional conditions apply:
You are responsible for maintaining the confidentiality of your access credentials. All activity performed from your account is considered to be performed by you.

EME reserves the right to suspend or terminate accounts that violate these conditions without prior notice.
Each plan has usage limits (contacts, sends, users, storage). Current limits are published in the pricing section of each platform. Exceeding limits may result in service restrictions or additional charges.
All intellectual property rights over our platforms, source code, designs, trademarks, logos, and documentation belong to EME Automations. Use of our services does not grant you any ownership rights over them.
You retain all rights over the data, content, and materials you upload or generate on our platforms. EME does not claim ownership of your content.
For custom development projects, ownership rights over the delivered work transfer to the client upon full payment, unless otherwise agreed in writing. EME reserves the right to use generic components and proprietary frameworks in other projects.
EME acts as a data processor for personal data that clients input into our platforms. We commit to:

We make every effort to keep our platforms available 24/7. However, we do not guarantee uninterrupted availability and will not be liable for temporary interruptions caused by scheduled maintenance, system updates, third-party provider failures, or force majeure.
To the extent permitted by law:
If the client cancels a project before completion, EME will retain the advance corresponding to work already performed. If cancellation is due to causes attributable to EME, 100% of the advance will be refunded.
SaaS services may be cancelled at any time. Cancellation takes effect at the end of the current billing period. No refunds are issued for partial periods. Upon cancellation, the client may export their data for 30 days, after which it will be deleted.
EME reserves the right to modify these terms at any time. Modifications take effect upon publication on this page. For active SaaS clients, we will notify significant changes at least 30 days in advance by email.
These terms are governed by Spanish law. For dispute resolution, both parties submit to the courts and tribunals of Seville, Spain, waiving any other jurisdiction that may apply.
